In simple terms: Kidney Solutions provides peer support and education. We are not doctors or lawyers. We do not guarantee transplant outcomes. You are responsible for the information you share with us. By participating, you agree to these rules.

 

By using this website or registering with Kidney Solutions, you agree to these Terms.

Kidney Solutions is a Texas nonprofit 501(c)(3) organization that provides free peer support and education related to kidney transplantation and living donation. Services are available to individuals residing in the United States.

1. Nature of Services & Financial Scope

Kidney Solutions provides peer support, education, and assistance with living donor search for our registered members.

We are not a medical provider and do not provide medical advice. All medical decisions must be made with your healthcare providers and transplant center(s).

Nothing we provide is medical, legal, or professional advice. Taking part in our programs does not create a doctor-patient or legal relationship.

Kidney Solutions may accept voluntary donations to support its charitable mission through third-party payment processors. Kidney Solutions does not accept, manage, or hold funds on behalf of individual members, donors, or third parties.

2. Privacy

Your use of Kidney Solutions services is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using our services, you confirm that you have read our Privacy Policy.

3. Electronic Communications

By registering with Kidney Solutions, you agree that we may contact you by email, phone, or text message for purposes related to peer support, program coordination, and event information. You may request to stop receiving communications at any time by emailing admin@kidneysolutions.org.

4. No Guarantees

Kidney Solutions does not guarantee transplant listing, transplant center acceptance, living donor identification, donor approval, transplant timing, or medical outcomes.

Registration on our website and participation in our programs is voluntary and does not ensure any specific result.

5. Eligibility and Accuracy of Information

By using our services, you represent that:

• You are physically living in the United States when you sign up and while using our services.
• You are at least 18 years old or have appropriate parental or guardian involvement.
• The information you provide to Kidney Solutions is truthful and accurate to the best of your knowledge and you agree to update us if material information changes.

Lying about where you live is a serious violation of these Terms and may result in immediate removal from the program.

6. Member Conduct

Participation in support groups is voluntary. While Kidney Solutions encourages respectful confidentiality among participants, we cannot guarantee that other participants will maintain confidentiality.

Members and support group participants agree to treat others respectfully and respect personal boundaries.

Harassment, discrimination, misrepresentation, impersonation, or harmful conduct is not permitted.

Kidney Solutions reserves the right to remove any member, restrict participation, or discontinue services to any member, family member, or potential donor at its discretion.

7. User-Submitted Materials

If you provide Kidney Solutions with materials such as photos, biographies, medical information, updates, donor search content, videos, or other written materials, you confirm that:

• You have the legal right to share the content;
• The information provided is truthful and accurate to the best of your knowledge;
• The content does not violate the rights of any third party.

Kidney Solutions does not independently check or verify the information you submit. We rely on what you tell us.

By submitting materials, you grant Kidney Solutions a non-exclusive, revocable license to use, reproduce, display, distribute, and format such materials for nonprofit purposes, including on our website, social media, and related outreach materials.

You are fully responsible for making sure your materials are accurate, complete, and lawful, including materials that have been reviewed, edited, or formatted by Kidney Solutions. Final approval of all materials rests with you.

You may withdraw consent for future public use of materials at any time by contacting admin@kidneysolutions.org. This does not apply to materials already shared before your request.

8. No Endorsement or Verification

Kidney Solutions does not independently verify the medical, personal, or financial information contained in member-submitted materials does not approve, confirm, or guarantee that the information is accurate or complete. Posting or sharing materials does not mean we approve or confirm any individual’s medical condition, transplant eligibility, donor suitability, or claims.

9. No Agency or Representation

Kidney Solutions does not act as an agent, legal representative, broker, or intermediary for any member, donor, or third party. Taking part in our programs does not create any partnership, employment, or legal relationship between you and Kidney Solutions.

10. Indemnification

By registering with Kidney Solutions and continuing to participate in our services, you agree to indemnify (protect), defend, and hold harmless Kidney Solutions: A Network of Transplant Experience, its directors, officers, volunteers, contractors, agents, and representatives from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:

• information you provide to Kidney Solutions;
• materials you submit, including photos, biographies, donor search content, or other media;
• your participation in peer support discussions or programs;
• your reliance on information obtained through Kidney Solutions;
• your violation of these Terms of Service; or
• your violation of any applicable law or the rights of a third party.

This indemnification obligation applies regardless of whether the claim arises from negligence, except to the extent caused by Kidney Solutions’ willful misconduct.

Kidney Solutions reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in such defense.

11. Intellectual Property

Website content and materials created by Kidney Solutions remain the property of Kidney Solutions.

Materials may not be reproduced for commercial purposes without written permission.

12. Third-Party Links

Our website contains links to third-party platforms. Kidney Solutions is not responsible for the content, privacy practices, or policies of third-party websites. Anyone visiting the Kidney Solutions website who chooses to use the third-party links is subject to the Privacy Policy and Terms of Service for all of the third-party websites they visit.

All information provided through Kidney Solutions is offered for educational and peer support purposes only.

Kidney Solutions is not affiliated with any transplant center. Kidney Solutions does not provide medical care or medical advice. Kidney Solutions does not participate in or influence decisions regarding transplant listing status, donor eligibility, or transplant center determinations.

Kidney Solutions uses third-party platforms and reasonable safeguards to protect information but cannot guarantee absolute security.

Our services are provided “as is” and “as available.”

We do not guarantee uninterrupted access, error-free functionality.

We do not guarantee provision of specific resources beyond a living donor search flyer for a living donor search.

We are not responsible for technical failures, outages, or events beyond our reasonable control.

14. Limitation of Liability

To the maximum extent allowed by law, Kidney Solutions: A Network of Transplant Experience and its directors, officers, volunteers, contractors, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to:

• medical decisions or medical outcomes;
• transplant center determinations or listing decisions;
• donor eligibility or donor approval decisions;
• actions taken based on peer support discussions;
• use of materials or information provided through our website or programs;
• technical failures, interruptions, or delays; or
• third-party services or platforms.

Kidney Solutions shall not be liable for any inaccuracies in member-submitted materials or for any actions taken by third parties based on such materials.

Participation in Kidney Solutions programs is voluntary, and users assume full responsibility for decisions made based on information received through the website or programs.

In no event shall the total liability of Kidney Solutions for any claim arising out of or related to the website or services exceed one hundred dollars ($100).

15. Assumption of Risk

Participation in Kidney Solutions programs, peer support discussions, and living donor search activities involve uncertainties and risks, including emotional distress, disappointment, and medical or logistical outcomes beyond our control. Kidney Solutions is not responsible for emotional distress arising from participating in our programs or interactions with other participants.

You voluntarily assume full responsibility for any decisions made based on information received through Kidney Solutions and acknowledge that outcomes related to transplantation or living donation are determined by medical providers and transplant centers, not by Kidney Solutions

16. Suspension or Termination

Kidney Solutions may suspend, restrict, or terminate access to our services or remove content if we believe these Terms have been violated or we determine that continued participation is disruptive or harmful to an individual or to the larger group of members.

We may also discontinue or modify our services at any time without liability.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without applying conflict of law rules.

Any legal action relating to these Terms must be brought in a court located in Texas.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. No Waiver

Failure of Kidney Solutions to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that provision or any other provision.

20. Survival

Sections relating to disclaimers, limitation of liability, intellectual property, and governing law survive termination of participation or use of services.

21. Changes to These Terms

We may update these Terms of Service from time to time. When updates are made, the Effective

Date at the top of this page will be revised. Changes become effective when posted.
